Eligibility Situations

To be eligible for this program, the noncitizen spouse must:
 

  • Have entered the U.S. without permission.

  • Be married to a U.S. citizen as of June 17, 2024.

  • Have lived continuously in the U.S. for at least 10 years as of June 17, 2024.

  • Meet other requirements related to criminal and immigration history.
     

This new program is distinct from the traditional PIP available to military family members, which was primarily designed to help spouses, children, and parents of U.S. military personnel, veterans, and those in the Selected Reserve. While the traditional PIP for military families also provides relief from deportation and the ability to apply for a green card, the new PIP program expands this benefit to a broader category of noncitizen spouses who have been in the U.S. for a significant period and have strong ties to U.S. citizen spouses.
 

Applications for this new PIP will be accepted starting August 19, 2024, using the new Form I-131F, which must be filed online. The program also offers:
 

  • Protection from deportation for three years.

  • Eligibility to apply for work authorization.
